Danish Expert Group’s 10 AI and Copyright Recommendations

The EU's competitiveness and cultural diversity are under pressure. This is also due to tech giants irresponsibly using other people's work, ignoring rights and thereby undermining the basis for human creativity – according to the Danish Minister of Culture: ‘We cannot tolerate this as a society.’ Therefore, the minister wants to put an end to the current situation where content can be used relatively easily in LLMs without agreement and payment to the rightsholder. The minister will take the lead in the EU.

The minister’s announcement today coincides with the launch of the Danish AI and Copyright Expert Group’s 10 recommendations. Danske Medier’s expert Dicle Duran Nielsen has advocated for free and pluralistic media and has, among other things, put forward proposals such as a reverse burden of proof with a presumption rule, an opt-in rather than opt-out model, and a final-offer arbitration framework.

The expert group’s work underscores the importance of standing together across sectors, industries, and borders to ensure that Denmark and Europe can lead the way in shaping a fair, innovative, and sustainable AI future for all.
