DPCMO has submitted its Digital Markets Act consultation response We should build a digital market where European media — large and small — can compete on merit, sustain independent journalism, and shield democracy.

Stronger and Faster Enforcement
– DMA must deliver practical change and be enforced effectively
– Close enforcement gaps where gatekeepers exploit legal uncertainty
– Integrate lessons from French Competition Authority (proactive action and measures)

Making Markets Work for Europe
– Protect fundament rights, competition, and democracy by ensuring fair remuneration, transparency, and access to audiences
– Avoid discrimination among EU member states; licensing deals must not exclude smaller markets

Clarify Overlap of DMA and Competition Law
– Provide guidance on how DMA enforcement interacts with TFEU Article 102 (abuse of dominance) to close legal gaps

Regulation Alignment
– Copyright exceptions in art. 3 and 4 in the DSMD were introduced to boost and stimulate European research and innovation
– Address copyright scraping and discriminatory licensing practices by AI developers.
– Ensure European publishers are compensated fairly for training data and outputs
