Danske Medier and DPCMO have delivered concrete solutions to the Danish Parliament:
– A legal presumption rule/reversal of the burden of proof
– Reinforcement of the original IP principle that content creators must have ultimate control over usage of their work, also in the context of data mining and AI; opt-in instead of opt-out
– Introduction of a European final-offer-arbitration model
– Updating of the DSM directive article 15 so big tech cannot circumvent the obligations by claiming the exceptions
– Wider access to data and greater transparency for kids and young people’s news consumption in big tech
– AVMS update so that all competing platforms are subject to the same obligations
– Citizens cannot be denied access to reliable news; blocking news and censorship must not be possible
– Strengthened competition oversight – ensuring a level playing field and action against unfair trading conditions
